Apostille for Portugal Visa: D7, Digital Nomad and Nationality Documents From the US
For a Portugal visa, an American needs the FBI police clearance apostilled by the US Department of State and any state record, such as a marriage or birth certificate, apostilled by the state that issued it. The Portuguese embassy sheet also puts a 90 day limit on that FBI record. This guide shows how to sequence the US steps so the clock does not run out before you file.
Portugal accepts the US apostille, and the window is short
Portugal has been a Hague Apostille Convention party since 4 February 1969, so a US apostille is the correct certification and no embassy legalization step follows. Portugal’s immigration agency AIMA says foreign public documents from Hague countries are recognized by apostille. The rest of this page is about the American side, which most Portugal guides skip.
Three things shape every file. The first is the FBI record, because the Washington embassy’s D7 sheet dated 10 November 2025 says it must be issued less than 90 days before you submit the visa application. The second is translation, because AIMA asks for certified Portuguese translations of foreign documents unless they are in English, French or Spanish. The third is nationality, because the law changed on 19 May 2026 and older checklists may predate it.
The FBI apostille is the document with the short fuse. Everything else on the list can wait for it.
Documents, apostilles and time limits by Portugal program
| Program | US documents | Apostille level | Validity window | Translation |
|---|---|---|---|---|
| D7 (pensioners and passive income). | FBI police clearance. Proof of address in the US. Pension or income proof. Marriage and birth certificates for family members appear on an older vendor checklist from 2020. | FBI: federal. State family records: state. | FBI record under 90 days before filing the visa application. | Not stated on the embassy sheet. Confirm with the consulate |
| Digital nomad (the official page does not use the label D8). | Criminal record if you lived in the US over a year. Income proof of at least four times the monthly guaranteed minimum remuneration. Fiscal residence document. Employment or service contracts. | FBI: federal. | Criminal record window is not on that page. Use the 90 days from the D7 sheet only if the consulate confirms. | Confirm with the consulate |
| Study and family reunification. | Document lists beyond admission or relationship proof not confirmed in our reading. | State records: state. | Confirm with the consulate. | Confirm with the consulate |
| Nationality by descent. | Apostilled birth certificate and the FBI record on the San Francisco consulate page. That page is undated and may predate the 2026 reform. | Birth certificate: state. FBI: federal. | San Francisco page: birth certificate within 6 months, other-country records within 3 months. | Confirm with the consulate |
The table follows the Washington embassy sheet, the national visa page at vistos.mne.gov.pt, the AIMA recognition page and the San Francisco consulate page. Where those pages are silent, we write “confirm with the consulate” instead of guessing.
Build the file from the shortest deadline backward
- 1
Fix the day you will submit the visa application
Everything counts back from it. The D7 sheet speaks of the police clearance being issued less than 90 days before submission. If your appointment slips, an FBI record that was fine on day 60 may be too old on day 100.
- 2
Gather the state records while you wait on slower items
Marriage certificates, birth certificates and any income or pension letters do not carry a window on the embassy sheet. Order them first, apostille them, and set them aside.
- 3
Time the FBI record last
Request the FBI Identity History Summary when the rest is ready. Then send it for the federal apostille the day it arrives. Our FBI report apostille service and the federal apostille guide describe that leg.
- 4
Check the consulate that covers your address
The Washington sheet asks for a lease or driver’s license to confirm jurisdiction. That request suggests each post serves defined areas. We could not confirm every post’s coverage, so look yours up before you book.
- 5
Translate where the consulate or AIMA requires it
AIMA exempts documents in English, French and Spanish and otherwise wants a certified Portuguese translation. Whether the same exemption applies when you file the visa at a consulate is not stated on the D7 sheet. Ask.
- 6
Assemble the set and keep copies
Apostilles are attached to the original page. Scan the full set before it leaves your hands, then ship the originals by tracked courier.
State versus federal, in one line each
- FBI Identity History Summary: US Department of State, Office of Authentications.
- Birth, marriage and death certificates: the state office that issued them, usually the Secretary of State.
- School records: the state of the school, after the registrar and a notary.
- Exceptions to the Secretary of State rule include Georgia, New Jersey, Wisconsin, Pennsylvania and Virginia, as the HCCH page for the United States lists them.
What changed on 19 May 2026 and what it means for your records
Portugal’s Ministry of Justice says Lei Orgânica 1/2026, published on 18 May and corrected by a rectification, took effect on 19 May 2026. The new provisions apply only to applications filed after that date. Cases already filed stay under the earlier wording.
The ministry lists what the law removed and what it added. It removed the special regime for descendants of Sephardic Jews. It removed some routes based on descent from a Portuguese citizen of origin or membership of a community of Portuguese ancestry. It added great-grandchildren of Portuguese citizens of origin. It also set the residence period for naturalization at 7 years for citizens of Portuguese-speaking countries and EU member states and 10 years for other nationalities.
The ministry’s news item does not mention grandchildren, so we do not say whether the grandchild route survived. Read the law text or ask a Portuguese lawyer before you build a file around it. Several provisions also depend on regulation, and the government has 90 days to update the nationality regulation.
For the American side, the practical point is this. The San Francisco consulate’s citizenship page is undated, asks for an apostilled birth certificate issued within the last six months, and says the US criminal record must be the FBI report. Because the page may come from before the reform, treat it as a starting point only. Confirm the current list with the consulate that will take your application.
Certified in Portugal is not the same as sworn in Spain
AIMA says foreign documents should come with a certified translation into Portuguese, except for documents written in English, French or Spanish. It lists who may make or certify the translation. They include a Portuguese notary, a registry officer, a lawyer practicing in Portugal, a recognized chamber of commerce and industry and a Portuguese consular official. The page says certified, not sworn.
We provide ATA certified translations that get notarized. We are not a sworn translator and we do not arrange sworn translations. Whether a US notarized translation satisfies the Portuguese certifier is not something the pages we read settle, so ask the consulate or AIMA before you pay for any translation. Our guide to translation and apostille order covers the mechanics. The existing Portuguese-language page, Serviço de Apostila para Portugal, explains our service in Portuguese.
Six ways a Portugal file stalls
FBI record too old
The 90 day limit starts at issue. Order it last, and apostille it the day it arrives. Do not let a bank letter hold the file.
State apostille on a federal document
No state can apostille an FBI report. A Secretary of State apostille on it is useless and costs you a week.
Short form certificate
Some states issue an abstract or short form. Ask for the long form certified copy with the raised seal so the apostille attaches to a full record.
Old checklist, new law
Nationality checklists written before 19 May 2026 may describe routes that no longer exist. Use the ministry page and your consulate.
Translating the wrong version
If the translator works from an unapostilled copy, the translation can drift from what you finally file. Translate the version you will submit.
Name mismatches
A missing middle name or a hyphenated surname that differs between passport and certificate leads to questions at the counter. Fix records before apostilling them.
Three typical Portugal files
These are composites, not named clients.
Two steps for the marriage record
A retired couple near Tampa needs their marriage record. The Florida Department of Health issues the certified record on its apostille application, and then the Department of State attaches the apostille. They order the marriage record first, then the FBI checks for both spouses, and file the visa within the 90 day window.
The county clerk copy is the starting point
A software contractor in San Diego needs a marriage record and an FBI check. The California Secretary of State apostilles the signatures of county clerks and recorders for $20 per document. The FBI check goes federal. The contractor files at the consulate that covers California after confirming the document list.
City records need the County Clerk first
A New Yorker researching nationality finds a birth certificate issued by New York City. The state process needs a New York County Clerk step, which costs $3 and comes before the Department of State apostille at $10. The applicant first confirms with the consulate that the great-grandchild route fits, since the law changed in May 2026.
A flat quote after a free review
We are a private document preparation and courier service in Tewksbury, Massachusetts, not a government office and not affiliated with any consulate or state office. We review your Portugal document list for free, split it into federal and state lanes and handle the apostille steps and the courier, including to a US address if you live abroad.
Our Massachusetts state apostille prices are Economy $149.95, Express $199.95 and Rush $385.95 per document, with the state fee and return postage included. Rush is the fastest, one to two days for Massachusetts and New Hampshire documents, and other states depend on the state office’s volume. Express takes two to five business days and Economy one to two weeks, with transit extra. For FBI apostilles and records from other states, we confirm the fee and speed during the free review and send one flat-rate quote before you pay. See pricing and how it works.

Frequently asked questions
Does the FBI check for the Portugal D7 visa need an apostille?
Yes. The Washington embassy sheet says that if you lived in the US over a year, the police clearance must come from the FBI with the Hague apostille. Because it is a federal document, the apostille comes from the US Department of State.
How recent must the FBI check be for the D7?
The sheet dated 10 November 2025 says issued less than 90 days before you submit the visa application. Order it near the end of your preparation and apostille it on arrival, so the window does not close before your appointment.
Do I need to translate my documents for a Portugal visa?
The D7 sheet does not say. AIMA requires a certified Portuguese translation for foreign documents unless they are in English, French or Spanish. Ask your consulate which rule it applies at the visa stage before paying for translation.
Does Portugal require a sworn translation?
AIMA uses the word certified, and lists notaries, lawyers, registry officers, chambers of commerce and consular officials as certifiers. We provide ATA certified translations that get notarized, but we are not a sworn translator and do not arrange sworn translations.
Which state apostilles my birth certificate for Portugal?
The state that issued it, generally its Secretary of State, with exceptions such as Georgia and New Jersey. The San Francisco consulate page asks for a birth certificate issued within six months for nationality, so order a fresh certified copy.
Did the 2026 law end Portuguese citizenship by descent?
No. The Ministry of Justice says Lei Orgânica 1/2026 removed some descent routes and the Sephardic regime and added great-grandchildren. Its page does not mention grandchildren, so confirm your route with the consulate or a Portuguese lawyer.
Is there a Portugal digital nomad visa called D8?
The official visa page asks digital nomads for contracts, income of four times the monthly minimum remuneration and a fiscal residence document, but it does not use the D8 label. Confirm the visa name and document list with your consulate.
How do I get documents apostilled for Portugal while living abroad?
Have certified copies sent to us or a US address, authorize us on the application form, and we manage the state and federal steps and ship the set. See our living abroad guide for courier timing.
