Apostille for Spain Visa: Which US Documents Need One and Who Issues It

An apostille for a Spain visa means two different offices. Your FBI background check gets a federal apostille from the US Department of State. Marriage and birth certificates, diplomas and other state records get an apostille from the state that issued them. This guide sorts each Spanish visa document into the right lane, with the dates that decide whether the consulate accepts it.

The short version

What Spain actually asks an American to apostille

Spain is a Hague Apostille Convention country, in force since 25 September 1978, so a US apostille is the right stamp and no embassy legalization is needed. The official Spanish consulate pages we read are specific on three points. The FBI check must carry an FBI apostille. State or local police certificates are refused. And the apostille does not need translating, while the translation does not need an apostille.

What those pages do not do is explain the American side. They never say that a Texas marriage certificate and an FBI check travel to different offices, or that the clock on your FBI check starts when it is issued, not when the apostille is added. That is the part this guide fills in. Everything about Spain below comes from the Consulate General of Spain in Boston and the Miami consulate sheet, because those are the pages we could read. Other consulates may add to them, so confirm with the one that covers your state.

Two offices, two lanes. The FBI check goes federal. Every certificate issued by a US state goes back to that state.

Read the table with one caution. It describes the Boston consulate’s published pages. Each Spanish consulate in the United States serves certain states and can have its own checklist, so use this as the American-side map and confirm the final list with your own consulate.

The US side, step by step

The order that avoids a second trip to the post office

  1. 1

    Pick your filing date first

The FBI check is the document with the shortest life. The Boston pages say six months before the application date, or before arrival in Spain for students. Back your plan out from the date you will file, not from today.

  2. 2

Order the FBI Identity History Summary

It must be the fingerprint based FBI record. A state police letter will not stand in for it. Our federal apostille guide walks through the path from fingerprints to the apostille.

  3. 3

Send the FBI record to the US Department of State

Federal agency documents are apostilled by the Office of Authentications, according to the HCCH page for the United States. No state office can apostille an FBI report, whatever state you live in. See our FBI report apostille service.

  4. 4

Order a fresh certified marriage copy from the issuing county or state

Spain wants family documents issued within the last 12 months. A copy from your wedding drawer will not meet that. Ask for a certified copy with the raised seal and the issuing official’s signature, never a photocopy and never a notarized photocopy.

  5. 5

Apostille each state record in the state that issued it

Most states use the Secretary of State. A few differ. Georgia uses the Superior Court Clerks’ Cooperative Authority, New Jersey uses the Division of Revenue and Enterprise Services, and Wisconsin uses its Department of Financial Institutions for vital records. The state-by-state office list shows yours.

  6. 6

Translate last, or ask the translator

The consulate says the translation needs no apostille and the apostille needs no translation. It does not say which comes first. Ask your translator whether they translate the apostilled page or the original, then keep both together.

Timing math

A realistic Spain schedule

  • FBI check and federal apostille: allow several weeks. We confirm the current timing during your free review.
  • State apostille for a marriage copy: days to weeks, depending on the state office.
  • Sworn translation: ask the translator for a date before you pay.
  • Consulate decision: up to 3 months from the day after filing (Boston non-lucrative page).
Consulates, jurisdiction and numbers

Which consulate, which rules, and the NIE question

Jurisdiction

Residence decides the consulate

The Boston consulate accepts non-lucrative applications only from permanent residents of Massachusetts, Rhode Island, New Hampshire, Maine and Vermont. It asks for proof of residence in that district. Students there may also qualify through their school. Spain also operates consulates in other US cities, and each covers its own states. We could confirm only Boston’s coverage for this guide, so look up your state on the Spanish foreign ministry’s consulate pages before you order anything.

How to file

In person, with money orders

The Boston non-lucrative page says the application must be submitted in person by the applicant and that it handles these visas directly, not through the outside visa vendor. US citizens pay by money order: $140 for the visa and $13 for Form 790. Student visas use a booking portal and the student fee page lists $160 for US citizens. Fees are non-refundable.

Residence card

TIE and NIE

The Boston page says you apply for the foreigner identity card, the TIE, within one month of entering Spain. It does not describe the NIE number by name, so we do not state any NIE rule here. If you need a NIE before the visa, such as for a lease, ask the consulate what it expects.

Other countries

Other places you lived

If you lived six months or more in another state or country in the last five years, the consulate also wants that jurisdiction’s police record, apostilled and translated. A record from a country that is not a Hague party needs Spanish ministry and consulate legalization. Start those early, they run on other countries’ clocks.

Translation, honestly

The traductor jurado reality

The Boston pages say the FBI record must be translated into Spanish by a sworn or certified translator. The Miami consulate sheet uses the term traductor jurado and points to the Spanish foreign ministry’s list of sworn translators. A sworn translator is appointed by Spain, so the work has to come from a person on that list. That is who the consulate expects to see on the translation.

We are a document preparation and courier service. We provide ATA certified translations that get notarized, and we are not a sworn translator and do not arrange sworn translations. If your consulate demands a traductor jurado for the FBI record, hire one, then send us the apostilled original or ship it to them yourself. Our guide to translation and apostille order covers how the pieces fit.

The same page asks that bank statements and tax returns need no translation, and the medical certificate may be in Spanish or translated. Do not pay a sworn translator for pages the consulate does not require.

Where it goes wrong

Six reasons a Spain visa file comes back

1

Wrong check

A state police record or a name based check is not the fingerprint based FBI record the Boston pages require. It cannot be rescued with an apostille.

2

Apostille from the wrong office

A state office cannot apostille an FBI report, and the US Department of State does not apostille a state marriage certificate. Match the document to the issuer.

3

Stale family documents

The 12 month limit on marriage and partnership documents catches people who order early. Check the issue date on the certificate, not the date of the apostille.

4

Check older than six months

The FBI record is dated when it is issued. A delay at the state or the translator can push you past the window before you reach the consulate.

5

Translation before the apostille was attached

The consulate treats them as separate. The risk is a translator working from an unapostilled copy that no longer matches your final set. Keep one version of the file.

6

Name mismatches

A middle name on the passport that is missing from the marriage certificate invites questions. Compare names across every document before you start.

Typical cases

Three typical Spain files

These are composites, not named clients. They show how the pieces fall in different states.

Typical case · Pennsylvania couple

The deputy signed the marriage certificate

A retired couple outside Harrisburg orders a certified marriage copy. The Pennsylvania Department of State rejects an apostille request where the county document was signed by a deputy or assistant clerk, so the couple has to ask the Register of Wills for a copy signed by the clerk in charge. The state fee is $15 per document. They then file the FBI checks federally, in a separate envelope.

Typical case · Texas remote worker

The marriage copy was too old

A remote worker in Austin has a marriage certificate from a county clerk. The Texas Secretary of State wants a certified copy issued within the past five years and the Spanish consulate wants one issued within 12 months. Ordering a fresh copy meets both rules. The FBI check goes to Washington in the same week.

Typical case · Massachusetts retiree

Everything local, one chain

A retiree in Worcester County lives in the Boston consulate’s district and applies in person. The FBI report gets its federal apostille, while a marriage record from the city clerk gets a Massachusetts apostille at the Commissions Section for $6. The consulate decision window is up to three months, so the couple books their lease start after the decision date, not before.

What we do and what it costs

Free review first, then one flat quote

We are a private document preparation and courier service in Tewksbury, Massachusetts. We are not affiliated with any consulate, embassy or state office. We review your list of Spain documents for free, tell you which lane each one belongs in, and handle the apostille steps and the courier.

For Massachusetts state apostilles our prices are Economy $149.95, Express $199.95 and Rush $385.95 per document, with the state fee and return postage included. Rush is the fastest, one to two days for Massachusetts and New Hampshire documents, and other states depend on the volume at the state office. Express takes two to five business days and Economy one to two weeks, with transit extra. For federal FBI apostilles and for records from other states, we confirm the fee and speed during the free review and send a single flat-rate quote before you pay. See pricing and how it works.

Spain apostille questions

Frequently asked questions

Does my FBI background check need an apostille for a Spain visa?

Yes. The Boston consulate says the FBI check must carry the FBI apostille. Because the FBI is a federal agency, the apostille comes from the US Department of State, not from a state Secretary of State.

How old can the FBI check be for the Spanish non-lucrative visa?

The Boston page says dated no more than six months before the application date. For a student visa it is six months before arrival in Spain. Count from the date the FBI issued it, and ask the consulate how it reads the apostille date.

Which state apostilles my marriage certificate for Spain?

The state that issued it. Most use the Secretary of State, with exceptions such as Georgia, New Jersey and Wisconsin. Spain wants marriage documents issued within the last 12 months, so order a fresh certified copy first.

Do I need a sworn translator for Spain?

The Boston pages say the FBI record needs a sworn or certified translator, and the Miami sheet says traductor jurado. We provide ATA certified translations that get notarized, but we are not a sworn translator, so hire one separately.

Does the translation come before or after the apostille?

The consulate says the translation needs no apostille and the apostille needs no translation. It does not state an order. Ask your translator which version they work from, and keep the apostilled original and the translation together.

Can I use a state police check instead of the FBI check for Spain?

Not at the Boston consulate. Its non-lucrative and student pages say state or local police certificates are not accepted. Only the fingerprint based FBI record qualifies, with a federal apostille.

Does the Spain digital nomad visa need an apostilled degree?

The Guadalajara consulate page asks for an apostilled degree with a Spanish translation, but it serves Mexico. For a US applicant, confirm with the consulate that covers your state before you order the apostille.

How do I get my documents apostilled for Spain if I live abroad?

Order certified copies mailed to a US address or to us, authorize us on the application form, and we handle the state and federal steps and ship the finished set. Our living abroad guide explains the courier steps.
