Apostille for Chile: Residency Documents From the US

Chile’s migration service wants every foreign document apostilled or legalized, and it sets short clocks on how old a record may be. Here is how Americans get the FBI check and other US papers apostilled in time, and what to do when two official pages disagree on the age limit.

The direct answer

Chile takes a US apostille, and the clock starts on the issue date

Chile has applied the Hague Apostille Convention since 30 August 2016, after joining by accession. The HCCH status table, updated 30 June 2026, notes no declarations. The Servicio Nacional de Migraciones (SERMIG) says every document issued abroad must be apostilled or properly legalized, and it cites articles 345 and 345 bis of the Código de Procedimiento Civil. For a US document that means an apostille from the US side. No Chilean consular stamp is added on top.

The document decides who apostilles it. The FBI Identity History Summary is federal, and the US Department of State, Office of Authentications, handles it. A state birth, marriage or death record goes back to the state that issued it. SERMIG’s pages do not say whether Chile prefers a federal or a state level. The HCCH page for the United States sets out the American rule, which we follow.

The apostille does not restart the clock. Chile counts from the day a record was issued, so every day in transit comes out of your window.

Two official numbers

The 60 day and 90 day conflict, stated plainly

SERMIG’s retiree and rentista page was updated on 18 December 2025. It says the criminal record certificate must be no more than 60 days old. SERMIG’s student page says the same. A different SERMIG page, the frequently asked questions, says the certificate from the country of origin may be at most 90 days old when you apply for definitive residence.

Both numbers are on official pages, and we cannot tell you which one an officer will apply to your file. The page for your specific permit is the safer guide, and the specific retiree, rentista and student pages say 60. Confirm with SERMIG in writing before you rely on 90. Until then, plan to 60 and treat 90 as slack you did not earn.

Plan to the shorter number. Losing 30 days of slack costs you nothing. Missing the 60 day window costs a new FBI report and a new apostille.

What each Chilean residence route asks for

The temporary residence pages list the retiree and rentista subcategory, called “Jubilados y rentistas”, and the student subcategory. We confirmed the points in the table on 26 October 2026. Other routes, including definitive residence and work permits, are not covered here, so confirm them with SERMIG.

Students can show funds through bank deposits, periodic transfers, a notarized sworn statement from a sponsor in Chile, or a scholarship certificate. SERMIG adds an exception for documents that set their own validity, so read the date on each one.

The date math

Counting back from the day you file

Think of the filing day as day zero and count backward. Every stage after a document is issued consumes part of its window. For an FBI report with a 60 day limit, that stage list is the federal apostille, the courier legs, any travel, and waiting for a SERMIG slot or a consulate appointment.

Private entity letter, such as a bank or employer pension letter.Issue date.30 days later.Order it last and notarize it the same day.
Passport.Today.Must be valid at least a year when applying from abroad.Renew before you start.

We do not know the current federal apostille time or the FBI’s turnaround. We did not read those pages, so look both up on the day you order and subtract them. SERMIG’s pages also do not say whether the clock stops at the apostille date. They say it runs from issue, so assume it does not stop.

Which class a US document belongs to is our reading, because SERMIG does not define private and public in the pages we read. Ask SERMIG to classify a bank letter, an employer pension letter and a Social Security letter before you order them.

Which American office handles each Chile document

Federal

FBI Identity History Summary

Chile asks for a record from the country of origin, which for an American is the US record. It is sent to the Department of State, Office of Authentications. Read our FBI report apostille service and the federal apostille guide.

Federal

Social Security or federal pension letter

This is a federal agency document, so it gets a federal apostille. SERMIG wants a pension certificate with amount and duration, plus the latest payment proof. Check the wording with SERMIG before you request the letter.

Private

Employer, bank or brokerage letter

Have it notarized, then send it to the office of the state that commissioned the notary. The Washington Secretary of State, for one, lists a $15 fee and 7 to 10 business days.

State

Birth and marriage certificates

Order certified copies from the registrar. The issuing state apostilles them. Our state-by-state vital records hub lists the offices and rules.

Translation

English documents need no translation, which saves real money

SERMIG says documents in a language other than Spanish or English need an official translation authorized by the competent body. English documents need none. Nearly every document an American holds is already in English, so you can skip the translation step. The exception is a record from a third country, such as a German police certificate for someone who lived in Germany.

Our ATA certified translations are notarized, but we are not a sworn translator and we do not arrange sworn translations. If SERMIG asks for an official translation of a foreign-language record, ask which body authorizes it and hire that professional. We can ship the apostilled original to them. See which comes first, translation or apostille.

Where it goes wrong

Six ways the 60 day window gets missed

Clock

Ordering early, filing late

A record issued in week one can be dead by week nine. Order the FBI report when you know your filing week.

Planning

Planning to 90 days

The 90 day figure sits on a different SERMIG page. The retiree, rentista and student pages say 60.

Private letters

A bank letter older than 30 days

Private entity documents have a shorter window than public ones. Request them last.

Other countries

A missing record from another country

Anyone who lived abroad during the last five years needs that country’s record, apostilled or legalized, and the 18 and over rule applies.

Wrong level

FBI report sent to a state office

The FBI report is federal. Massachusetts and New York, for example, do not apostille federal documents.

Passport

Under a year of validity

SERMIG asks for a passport valid at least a year when you apply from abroad. Renewal can take longer than the apostille.

Typical cases

Three situations we see, written as typical examples

These are typical situations, not named clients.

Florida · Retiree

A retiree moving to Santiago

A retiree in Florida requests a benefit letter and an FBI report in the same week so both carry similar issue dates. Both go to the US Department of State. A marriage certificate for a spouse goes through the Florida Department of State in Tallahassee, which publishes no mail processing time.

Washington · Rentista

An investor with brokerage income

The brokerage letter is a private entity document with a 30 day window. It is dated, notarized in one visit and sent to the Washington Secretary of State. The FBI report is ordered separately so its 60 day window is not spent waiting on the letter.

Texas · Student

A graduate heading to a Chilean university

The enrollment certificate comes from the school, so the US item is the FBI report. The student counts back from the consulate appointment and confirms with SERMIG whether degrees are wanted at all.

Chile residency questions

Frequently asked questions

How old can my FBI check be for Chile?

SERMIG’s retiree, rentista and student pages say no more than 60 days from issue, and one FAQ says 90 days for definitive residence. These two official sources conflict. Confirm with SERMIG and plan to 60 until you have the answer in writing.

Does my English-language document need translating for Chile?

No. SERMIG says only documents in a language other than Spanish or English need an official translation. A US birth certificate, FBI report or benefit letter in English needs none. A record from another country in a third language may.

Do I need an apostille on my pension letter for Chile?

Yes. SERMIG says the retirement certificate showing amount and duration must be legalized or apostilled, with the latest payment proof. A federal agency letter takes a federal apostille. A private pension letter is notarized, then apostilled by the notary’s state.

Which other countries’ records do I need?

SERMIG asks for a criminal record from the country of origin and from any country where you lived during the last five years, for applicants 18 and over. Each record needs its own apostille or legalization from the country that issued it.

Does Chile accept a US apostille?

Yes. Chile is a Hague party by accession, in force 30 August 2016, and SERMIG accepts documents apostilled or properly legalized. A US document needs an apostille, and no Chilean consular legalization is added on top.

Is there a Chilean visa for retirees and rentistas?

SERMIG lists a temporary residence subcategory called Jubilados y rentistas. Its page was updated on 18 December 2025. Confirm the current list of documents and the income or pension amounts directly with SERMIG before you order anything.

Do degrees and transcripts need an apostille for Chilean study?

The student page we read does not list degrees or transcripts, so we cannot say. It does list an enrollment certificate, a criminal record and proof of funds. Ask SERMIG or the university whether they want a degree.

Must the apostille be federal or state level for Chile?

SERMIG’s pages do not say. The US rule decides: the US Department of State apostilles federal documents such as the FBI report, and the issuing state apostilles state records and notarized private documents.
