Apostille for China: What Replaced Consular Legalization and How U.S. Documents Are Prepared Now

Until November 2023, a Massachusetts diploma bound for a Chinese work permit went through the Commonwealth, the U.S. Department of State and the Chinese consulate in New York, in that order, over six to eight weeks. China joined the Apostille Convention on November 7, 2023 and the consulate step disappeared. Here is what the process looks like now for work permits, family visas, company registrations and property matters, and the parts that did not change.

  • Work permit packages: degree, record check, TEFL
  • Corporate documents for WFOE and joint ventures
  • State and federal apostilles in one order
  • Trusted since 2010
What changed

The consulate step is gone. The state and federal steps are the whole process.

Before November 7, 2023, mainland China was outside the Hague Convention, so an American public document needed the full legalization chain: certification by the state, authentication by the U.S. Department of State, then legalization by the Chinese embassy or a consulate. Each step had its own fee, form and queue, and a single document routinely took six to eight weeks.

On that date the Convention entered into force for the People’s Republic of China. An apostille issued by a state Secretary of State, or by the Department of State for federal documents, is now the final step. The Chinese embassy and consulates in the United States stopped legalizing documents for use in the mainland the same week. Documents legalized before that date remain valid.

What did not change is everything before the apostille. A diploma still needs a notarized copy or a registrar’s certification. An FBI check is still federal and still goes to Washington. A Delaware certificate of incorporation is still apostilled in Dover, not Boston. And Chinese authorities still want Chinese translations, usually produced in China by a licensed translation company. Our apostille vs legalization guide explains the two systems side by side.

China did not lower its standards for foreign documents. It removed one office from the queue.

Document by document

The U.S. documents Chinese authorities ask for

Each goes to its own apostille authority. The employer, bureau or lawyer in China has the current list.

Work permit · Z visa

Degree, criminal record check, TEFL

The Foreign Experts Bureau wants the highest degree certificate, a criminal record check dated within six months, and for teachers a TEFL certificate. The degree and TEFL are notarized copies apostilled by the Commonwealth. The record check is the FBI Identity History Summary authenticated in Washington. Our diploma service and FBI check page cover both.

Family · S and Q visas

Marriage and birth certificates

Spouses and children joining a worker need apostilled marriage and birth certificates. Massachusetts certified copies are apostilled in Boston. Other states’ records in their own capitals. Registries want recent certified copies. See the marriage certificate service.

Company · WFOE, JV, representative office

Incorporation documents and powers of attorney

Certificate of incorporation or good standing, articles, a board resolution, a power of attorney for the local agent and a notarized copy of the legal representative’s passport. Massachusetts corporate certificates are apostilled by the Commonwealth. Delaware entities are apostilled in Dover. The corporate documents guide and Delaware guide cover both.

Property and inheritance

Powers of attorney, death certificates, kinship affidavits

Selling a Shanghai apartment from Boston or settling a parent’s estate needs a power of attorney in the form the Chinese notary office expects, signed before a Massachusetts notary and apostilled, plus apostilled death and kinship documents. Chinese notary offices are exacting about wording. Get the draft from the lawyer in China first.

Study

Diplomas and transcripts for Chinese universities

Degree programs and the Chinese Service Center for Scholarly Exchange want apostilled diplomas and transcripts. Registrar certifications before a notary are the cleanest route. Campus specifics are in our MIT, Boston College and other university guides.

Personal

Passport copies, single status affidavits, name changes

A notarized passport copy for a bank account, a single status affidavit for a marriage registration, a court name change order for a household registration update. Each is notarized or certified here and apostilled by the Commonwealth. The passport copy guide covers the first.

Step by step

How a Massachusetts document reaches a Chinese office now

1. Get the exact list from the receiving side

The Foreign Experts Bureau in one city, a notary office in another and a bank in a third do not want the same things, and local bureaus adopted the apostille at different speeds through 2024. Ask the employer, lawyer or bureau for the list in writing, including whether the translation is to be done in China and whether the apostille must be on the original or on a notarized copy.

2. Prepare the document for its authority

Private documents, diplomas, TEFL certificates, powers of attorney, passport copies, are notarized by a Massachusetts notary and go to the Commonwealth. Public records, birth, marriage, death, court judgments, corporate certificates, are certified by the issuing office and go to the Commonwealth. Federal documents, FBI checks, USCIS records, go to the Department of State. Our state versus federal guide sorts every type.

3. Apostille

Massachusetts documents are apostilled at One Ashburton Place, same day on a walk-in, two to three weeks by mail. Federal documents are authenticated in Washington, about five weeks by mail or seven to ten business days through our agent. Out of state documents go to their own capitals.

4. Translate in the right place

Most Chinese authorities want a Chinese translation produced by a licensed translation company in China, with the company’s stamp. A translation made in the United States is sometimes accepted if notarized and apostilled as well, which adds a second apostille. Ask before paying for a translation here. The translation sequencing guide explains the two apostille case.

Timing the criminal record check

Chinese bureaus want the record check issued within six months of the work permit application, and some within three. Request the FBI check after the employer has confirmed the application date, then send it to Washington the day it arrives. An FBI check ordered early to “get it out of the way” is the most common reason a China file is redone. The health check, by contrast, is done in China after arrival and does not need an apostille.

Names, pinyin and matching documents

Chinese offices read every document against the passport. A diploma issued in a maiden name, a marriage certificate in a married name and a passport in a hyphenated name will be questioned. Where the documents differ, the record that explains the change, usually the marriage certificate or a court order, is apostilled and added. For Chinese nationals with U.S. documents, the pinyin spelling on the American record should match the passport exactly, and a notarized statement of the Chinese characters is sometimes requested by notary offices in China.

5. Deliver

Chinese bureaus want the original apostilled document, not a scan, though many accept a scan to start processing. We ship tracked to addresses in China daily, and we keep a photo of every apostille before it leaves.

Before you order

China checklist

  • Written list from the employer, bureau or lawyer in China.
  • Know whether each document is private, state public or federal.
  • Criminal record check timed within six months of the application.
  • Translation plan: in China, or here with a second apostille.
  • Hong Kong, Macao or Taiwan? Different rules. See below.
Not one China for documents

Mainland, Hong Kong, Macao and Taiwan follow different rules

Mainland

Apostille since November 7, 2023. Documents issued in the mainland for use in the United States are apostilled by China’s Ministry of Foreign Affairs or by authorized provincial Foreign Affairs Offices, replacing the notarization plus consular legalization route American offices used to require.

Hong Kong and Macao

Both have been inside the Convention for decades and their documents carry apostilles from the High Court in Hong Kong and the relevant office in Macao. A U.S. apostille has always been enough for documents going there. Nothing changed in 2023.

Taiwan

Taiwan is not a party to the Convention. Documents for use in Taiwan are certified by the state, then authenticated by the Taipei Economic and Cultural Office with jurisdiction, TECO Boston for Massachusetts documents. Sending a Taiwan bound document through the federal apostille route is a wasted step. TECO wants the state certification. Plan two to four weeks.

Documents in the other direction

A Chinese birth certificate, degree or marriage record for use in Massachusetts now arrives with a Chinese apostille and a certified English translation, and American offices accept it without the old consular chain. Our verification guide explains how an American office checks a foreign apostille.

From our desk

Three China files, before and after the change

Names changed. The first is from the old system. The other two from the new one.

Work permit · Shenzhen, 2023

Seven weeks through the consulate

A software engineer in Cambridge needed his diploma and FBI check for a Shenzhen work permit in the summer of 2023. Diploma to Boston, FBI check to Washington, both to the Chinese consulate in New York, with the consulate’s own forms, fees and a two week queue. Forty nine days. He started the job three weeks late.

Work permit · Hangzhou, 2025

Twelve business days

A teacher in Quincy had the same two documents plus a TEFL certificate for a Hangzhou school. Diploma and TEFL apostilled at One Ashburton Place on a walk-in, FBI check through our Washington agent in eight business days, translations done by the school’s agency in Hangzhou. Everything shipped on day twelve. The Foreign Experts Bureau approved the permit in the following week.

Subsidiary · Suzhou, 2026

Delaware, Massachusetts and a power of attorney

A Waltham company forming a WFOE needed its Delaware certificate of good standing, a Massachusetts foreign registration certificate, a board resolution and a power of attorney for the Suzhou agent. Delaware apostilled its certificate in Dover, the Commonwealth apostilled the other three, and the company’s Chinese counsel handled translations. The resolution had to be re-signed once because the Chinese notary office wanted the legal representative’s passport number in the text. Ask for the draft first.

The lesson across all three

The apostille shortened the calendar by weeks, and the remaining delays all sit in the preparation: the notarized copy, the timing of the record check, the wording a Chinese office expects. Those are the steps to get right before anything is mailed.

Where people still lose time

Sending the FBI check to Boston. Using an old consulate legalization checklist from a 2022 blog post. Paying for a Chinese translation here that the bureau will not accept. Treating a Taiwan document like a mainland one. Each costs two to four weeks. Our mistakes guide covers the rest of the list.

China questions

Frequently asked questions

Does China accept apostilles now?

Yes. The Apostille Convention entered into force for the People’s Republic of China on November 7, 2023. A state or federal apostille is the final step for a U.S. document used in the mainland, and Chinese consulates no longer legalize documents for that purpose.

Do I still need the Chinese consulate to legalize my documents?

No, for mainland China. The consulate step ended in November 2023. Documents legalized before that date remain valid.

Which documents does a Chinese work permit need?

The highest degree certificate, a criminal record check dated within six months and, for teachers, a TEFL certificate, each apostilled. The degree and TEFL are notarized copies apostilled by the state. The FBI check is authenticated by the U.S. Department of State.

Where should the Chinese translation be done?

Usually in China, by a licensed translation company whose stamp the bureau recognizes. A U.S. translation is sometimes accepted if it is notarized and apostilled separately. Ask the receiving office before paying for either.

Does the apostille work for Hong Kong, Macao and Taiwan?

Hong Kong and Macao have accepted apostilles for decades. Taiwan is not a party to the Convention. Documents for Taiwan are certified by the state and authenticated by TECO, not apostilled federally.

How long does a China package take now?

About five business days for Massachusetts documents and seven to ten business days for federal ones through our Washington agent, plus shipping. The old six to eight week consulate chain is gone.

Can Massachusetts apostille my FBI check for China?

No. The FBI check is a federal document and is authenticated only by the U.S. Department of State. Sending it to Boston returns it unprocessed.

How is a Chinese document authenticated for use in Massachusetts?

Since November 2023, by an apostille from China’s Ministry of Foreign Affairs or an authorized provincial Foreign Affairs Office, with a certified English translation. No U.S. consular step is needed.
