Delaware Vital Records Apostille From Abroad: A Company Registry Office Handles Your Personal Papers

A Delaware vital records apostille is not issued by the health department or the Secretary of State’s usual front desk. In Delaware it comes from the Division of Corporations in Dover, and the state charges $30 in total for personal documents presented together. The unusual part is which office issues your certified copy first.

The short version

Who does what in Delaware

Consider an engineer who moved to Berlin on a Blue Card after marrying in New Castle County. The German residence office wants the marriage certificate with an apostille, and the engineer is an ocean away from anyone who can hold the paper. This is the typical Delaware case, and the answer has two stops in Dover.

The first stop is the Office of Vital Statistics in the Division of Public Health, which issues the certified copy of a birth, marriage or death record. The second is the Division of Corporations, which the state uses as its apostille desk. They sit in different Dover buildings and do not share a counter.

One order to the Division of Corporations can carry several personal documents for a single $30.

Birth, marriage, death and divorce in Delaware

Delaware’s apostille pages do not describe vital records at all, which is why the free review matters. The Division of Corporations says it accepts documents bearing Delaware notary or public-official signatures and official copies from state or county officials. Whether the health office’s signature is on file is not stated, so it appears below as a question to confirm.

How to apostille a Delaware birth certificate

Order the certified copy from the Office of Vital Statistics, confirm the signature question with the Division of Corporations, then submit it in Dover.

The Dover apostille desk

What the Division of Corporations says about personal documents

Delaware’s non-commercial apostille page covers a person’s own documents. The fee is $30 for all documents presented together, so a birth, marriage and death certificate can travel in one submission for a single state fee. Company paperwork is a different story. Commercial documents are $30 each and have their own expedite tiers, which a personal order does not receive. For company records, see our Delaware company guide.

Mail goes to the Townsend Building at 401 Federal Street, Suite 4, or to P.O. Box 898. The Division helps in person by appointment, and the number is (302) 739-3077. The page for the apostille information also says the office does not accept documents notarized remotely or electronically. If you used an online notary for a statement, it will be rejected, so plan an in-person notary.

Do not confuse the apostille desk with the health office. The Office of Vital Statistics counter is at the Cooper Building at 417 Federal Street, a separate building. When you book a visit, confirm which address the staff gives you.

The route

Two stops in Dover, then the courier

The health office or court issues the copy, the Division of Corporations apostilles it, and the courier takes it abroad.

The distance between the two Dover offices is short, but your paper only moves between them if someone carries or mails it. We do that part.

Doing it from abroad

The order of steps when you live outside the United States

  1. 1

Confirm what the foreign office will accept

Germany.info says an apostille is needed on a US marriage certificate for a German residence permit, and Spain’s student visa asks for a minor’s birth certificate issued within 90 days of the application. Ask for the age rule in writing before ordering.

  2. 2

Order the copy from the Office of Vital Statistics

Send the application, a photo ID copy and the $25 fee. The office takes credit cards only through its online certificate service, not on the paper form. Relationship proof is needed for death records. Have the copy delivered to a US address, not overseas.

  3. 3

Ask whether the signature is on file

The Division’s pages do not mention vital records. We ask it before the original moves, so you do not pay for a trip that gets refused. Where Delaware allows an authorized third party to order, we can request the copy, and the free review confirms whether that fits your record.

  4. 4

Send the set in one submission

Put the birth, marriage and death records into a single non-commercial submission, because $30 covers the batch. The Division typically returns mail submissions the same business day, so the real delays are your own mail and the courier.

  5. 5

Courier it to you or to the receiving office

Dover is on Eastern Time, six hours behind Berlin and Madrid for most of the year. Book DHL, FedEx or UPS with tracking and an address that can sign. Customs checks can add a day.

Where it goes wrong in Delaware

Six Delaware mistakes that cost a week

Online notary

Remote or electronic notarization

The Division does not accept it. A single-status statement or affidavit that was notarized over video will come back unprocessed.

Divorce from the wrong office

Asking Vital Statistics

The state office does not give certified divorce copies. The decree is a court record from the Prothonotary or the Family Court.

Wrong Dover building

Federal Street, two numbers

The health counter and the apostille desk are different buildings. A visit to one does not help at the other.

Earlier records

Before 1974

The state office holds marriages and deaths from 1974, per a federal listing, with earlier deaths in the Public Archives. Confirm what the office holds before ordering.

Unknown signature

Vital Statistics on file?

The Division’s pages do not say whether the health office signature is on file. Confirm before sending the original.

Commercial expedite

Expecting a one-hour tier

The 24-hour to 1-hour tiers are for commercial work. A personal batch gets normal handling.

Using it abroad

Two destinations Delaware families ask about

Germany

Germany is a Hague party (HCCH status table), and its US missions cannot issue apostilles. They tell applicants that an apostille from the state of issue is needed on a US marriage certificate used for a residence permit. We have not confirmed German rules on translations or document age, so ask the local Ausländerbehörde or the mission what it wants.

Spain

Spain is also a party. For a student visa, the consulate page we read asks for a minor’s birth certificate or guardianship papers issued within 90 days, with foreign documents apostilled. The translation must be into Spanish. Our ATA certified translations get notarized. We are not a sworn translator and we do not arrange sworn translations. When Spain asks for one, a sworn translator in Spain does the work and we ship the apostilled set to that person.

What we do and what it costs

Handling both Dover stops for you

Tewksbury, Massachusetts is our base. We are a private document preparation and courier service close to Boston, working for overseas clients since 2007. For a Delaware record we order the copy where the state allows it, ask the Division the signature question, assemble one submission and return the finished set to you.

The $149.95, $199.95 and $385.95 rates on our pricing page belong to Massachusetts apostilles. Delaware gets its own quote. At the free document review we check the Delaware fee and speed and put one flat-rate figure in front of you before any payment. Rush is our fastest level, and the other states depend on the volume at the state office. Express runs 2 to 5 business days, Economy 1 to 2 weeks, and transit is extra. Read pricing and how it works, or go straight to the application form. The phone is (978) 424-4629.

We have no affiliation with a state office or a consulate.

Questions we hear

Delaware vital records apostille questions

How do I get a Delaware record apostilled from abroad?

Order a certified copy from the Office of Vital Statistics, or the county court for a divorce, and have it sent to a US address. Then it goes to the Division of Corporations in Dover with the $30 fee. We coordinate both stops and ship the finished set to you.

Which Delaware office issues the apostille for a marriage certificate?

The Division of Corporations in Dover, not the health office. The health office, the Office of Vital Statistics, issues the certified copy. The Division’s pages do not describe vital records, so confirm with the office that the health office signature is on file before you send the original.

How much does a Delaware apostille cost?

For personal documents, the Division of Corporations charges $30 in total when the documents are presented together. Company documents are $30 each. The certified copies are separate, at $25 per birth, marriage or death record from the Office of Vital Statistics. Our own fee is quoted after the free review.

How fast is Delaware for a personal document?

The state’s page says non-commercial documents are typically processed the same business day by mail, and the commercial expedite tiers do not apply. The slow parts are your mail and courier time. Confirm current handling with the Division before you set a deadline.

Does Delaware issue a certified copy of a divorce decree from the state office?

No. A federal listing says the state office has divorce records since 1935 but cannot issue certified copies. The decree comes from the county Prothonotary for divorces through 1975 and from the county Family Court after that. Confirm the court fee with the clerk.

Will Delaware accept an online or remote notarization?

No. The Division of Corporations says it does not accept documents notarized remotely or electronically. If your statement needs a notary, have it done in person with a traditional notary. We confirm the notary step in the free review.

What if my Delaware marriage or death record is from before 1974?

A federal listing says the Office of Vital Statistics holds marriages and deaths from 1974, with earlier deaths at the Delaware Public Archives in Dover. Earlier marriages are not confirmed. Ask the office what it holds before you order, and tell us at the start of the review.

Is the Division of Corporations the same as Vital Statistics?

No. They are two Dover offices on Federal Street in different buildings. Vital Statistics issues the certified copy at 417 Federal Street. The Division of Corporations, at 401 Federal Street, adds the apostille. Confirm the address when you book an appointment.
