District of Columbia Vital Records Apostille From Abroad: Why the State Department Is the Wrong Door

A district of columbia vital records apostille comes from the Office of Notary Commissions and Authentications, known as ONCA, for $15 per document. DC records are local, so they do not go to the U.S. Department of State even though the city is the federal capital. ONCA says mail-in orders come back within 5 business days.

The short version

Four DC offices, one apostille desk

A couple marries at the Superior Court on Indiana Avenue while working on Capitol Hill. Years later they live in Madrid and the consulate wants the marriage certificate apostilled. They search for the State Department, because Washington is the federal city. That is the wrong office. The U.S. Department of State apostilles federal agency documents, and the HCCH page for the United States says documents issued by the District go through the District’s own authority.

For DC that authority is ONCA, part of the Office of the Secretary of the District of Columbia. It verifies that the signer on your document is a commissioned notary or a DC government official. It does not read the content.

DC records start at four different offices and finish at one desk on North Capitol Street.

The four records side by side

Birth, marriage, death and divorce in Washington, DC

DC splits its vital records between the health department and the courts. DC Health’s own vital records page lists birth, death and domestic partnership but not marriage or divorce.

How to apostille a District of Columbia birth certificate

Order it from DC Health, which can forward a birth certificate directly to ONCA, or send the copy to North Capitol Street yourself.

The ONCA desk

What the DC authentications page says

The authentications page on os.dc.gov says ONCA authenticates documents notarized by a DC notary and certified documents issued or signed by a DC government agency. The fee is $15 per document. Mail-in requests come back within 5 business days, and walk-ins are same day from 9:00 AM to 1:00 PM on weekdays with no appointment. Third parties are allowed at the counter, so someone you trust can hand your set over if you are abroad.

One detail needs care before you mail anything. The page prints the street address as North Capitol Street NE in most places and NW in one line. We use NE and confirm it by phone at (202) 727-3117 before every shipment. The page does not mention an online or e-apostille option, so assume paper.

For a death certificate, the DC Health death certificate page states that DC Health does not issue apostilles and sends you to ONCA. For a marriage or divorce record, nothing on the pages we read confirms that the Superior Court clerk’s signature is on file, so we ask ONCA first.

Doing it from abroad

From a laptop overseas to a finished apostille

  1. 1

Pick the right DC office for the record

A death certificate comes from DC Health. A marriage certificate comes from the Superior Court Marriage Bureau. A decree comes from the court. Ordering a marriage record from DC Health wastes a week.

  2. 2

Check who is allowed to order it

The DC Health death page lists eligible requesters. If you are abroad and not on the list, a spouse or a legal representative can order for you. Where DC allows an authorized third party to order, we can request the copy, and the free review tells you if your record qualifies.

  3. 3

Add the ONCA step to the same order when possible

For a birth certificate, DC Health can order and forward it to ONCA. For a death certificate, order the copy, then send it to ONCA yourself or through us. Marriage and divorce copies travel the same way.

  4. 4

Mail it or hand it over

Mail returns within 5 business days after ONCA receives it, per the page. A walk-in is same day. If you or a relative are in DC on a weekday morning, a hand delivery before 1:00 PM works.

  5. 5

    Ship the apostilled set abroad

Washington shares Eastern Time with our Tewksbury office, six hours behind Madrid for most of the year, so call ONCA in your afternoon. DHL, FedEx and UPS give the best tracking. Ask the receiving office how many originals it wants.

Where it goes wrong in DC

Six DC mistakes that send documents back

Wrong agency

The State Department

DC records are not federal documents. Mailing a DC death certificate to the State Department in Washington sends it to an office that will not apostille it.

Marriage ordered from DC Health

Wrong office

DC Health does not list marriage records. The Superior Court Marriage Bureau does. An order sent to the health department is wasted.

Spouse ordering a birth certificate

Restricted requester

Spouses cannot order a DC birth certificate, but they can order a death certificate. The rules differ by record.

Mixed-up address

North Capitol Street NE or NW

The page prints both. Confirm the mailing address by phone before you ship an irreplaceable original.

Missed the walk-in window

9:00 AM to 1:00 PM

The counter is open only until 1:00 PM on weekdays. Anyone delivering for you needs to be there before that.

Unconfirmed court signatures

Marriage and divorce clerk

The ONCA page does not confirm that the Superior Court clerk’s signature is on file. Ask first, then mail.

Using it abroad

Spain and Portugal, the two requests we see most from DC

Spain

Spain is a Hague party (HCCH status table). The Consulate General in Boston lists family documents, including a marriage certificate, for the non-lucrative residence visa. It asks that marriage and similar family documents, other than birth certificates, be issued within the last 12 months and be in Spanish. Spain’s consulate pages say the translation and the apostille do not need to be processed together. The FBI check is a federal order, handled separately from the ONCA step.

Portugal

Portugal is also a Hague party. The AIMA agency recognizes foreign documents through the apostille and asks for a certified Portuguese translation, except for documents in English, French or Spanish. ATA certified translations that get notarized are something we provide. We are not a sworn translator and we do not arrange sworn translations, so if a Portuguese office wants a different certification, the right professional there handles it and we ship the apostilled set to them. The Embassy of Portugal in Washington publishes its own visa checklists.

Questions we hear

District of Columbia vital records apostille questions

How do I get a Washington DC record apostilled from abroad?

Order the certified copy from DC Health or the Superior Court, then send it to ONCA at 899 North Capitol Street NE with the $15 fee. A trusted person can also hand it over at the counter. We coordinate the copy, the ONCA step and the courier abroad for clients in Boston and overseas.

Does the U.S. Department of State apostille DC vital records?

No. The State Department handles federal agency documents. Documents issued by the District of Columbia go through the District’s authority, which is ONCA. Sending a DC certificate to the State Department wastes weeks, so confirm the issuer of each document before you ship.

How much does a DC apostille cost?

ONCA charges $15 per document. DC Health lists $18.00 for a death certificate, and VitalChek adds $6.00 by mail or $15.95 by phone or online. A birth certificate is $23. Marriage and divorce fees are shown in a federal listing at $10.00 and $6.50, so confirm with the court.

How long does a DC apostille take?

ONCA says mail-in requests come back within 5 business days and walk-ins are same day between 9:00 AM and 1:00 PM on weekdays, with no appointment. Courier time to your address is extra. We confirm current timing in the free review.

Who may order a DC death certificate?

DC Health lists a spouse or domestic partner, a parent, an adult child, a sibling, a grandparent with proof, a guardian and a legal representative. Records are public after 75 years. Unlike a DC birth certificate, a spouse may order a death certificate.

Where do I get a DC marriage certificate?

From the DC Superior Court Marriage Bureau at 500 Indiana Avenue NW, Room 4485, not from DC Health. A federal listing shows a fee of $10.00. Whether the clerk’s signature is on file at ONCA is not stated on its page, so confirm with the office before mailing.

May someone else take my documents to ONCA in person?

Yes. ONCA’s page says third parties are allowed at the walk-in counter, open 9:00 AM to 1:00 PM on weekdays with no appointment. A friend, relative or courier can hand over the set with payment. We can arrange this for clients abroad.

Can DC Health send my birth certificate straight to ONCA?

Yes, for a birth certificate. DC Health can order the record and forward it directly to ONCA, per the ONCA page, which names birth certificates and GED records. The page does not name death records, so confirm with the office for other record types.
