New York Vital Records Apostille: The County Clerk, the NYC Offices and the Letter of Exemplification
A New York vital records apostille depends on who signed the copy. State Health Department copies go straight to the Department of State for $10. Local and New York City copies need a County Clerk first, and a New York City death certificate also needs a Letter of Exemplification.

The signature on your copy decides which lane you are in
A typical case: a woman in Rome is assembling an Italian citizenship file and needs her grandfather’s Brooklyn death certificate apostilled. She orders an ordinary copy from the city. It is a genuine record, and it cannot be apostilled yet. In New York the question is never just which record. It is who signed the copy in your hand.
Lane one is a copy issued by the State Department of Health in Albany and signed by the Director of Vital Statistics, the State Registrar. It goes directly to the Department of State. Lane two is a copy signed by a local official, such as a city, town or village clerk or registrar. The County Clerk of that county must certify it first. Lane three is a New York City record from the Health Department or the City Clerk. It must be certified by the New York County Clerk, which costs $3.
Say “for an apostille” at the moment you order. Ask for the long form where it exists. An ordinary certificate issued right after a ceremony will not do for a marriage used abroad.
The four records, lane by lane
New York keeps state level birth, marriage and death records outside the city, and the city keeps its own for the five boroughs. Fees in the table are what the official pages show. Several are snippet level or old, so confirm before paying.
| Record | Who issues the copy | What it must show | Copy fee | Extra step |
|---|---|---|---|---|
| Birth. | NYC: Health Department. Elsewhere: State Department of Health or the local registrar. | NYC needs a Letter of Exemplification and the long form. State copies carry the State Registrar signature. | NYC $15. State $30 to $45. | County Clerk for NYC and local copies. |
| Marriage. | Outside NYC: State Health Department or the city, town or village clerk. NYC: City Clerk Marriage Bureau, not the Health Department. | Ask for the extended certificate for foreign use in NYC. The ordinary one is the wrong kind. | State $30. NYC extended $35 first copy, page dated 2021. | New York County Clerk for NYC copies. |
| Death. | State Health Department outside NYC, or the local registrar. NYC Health Department for the five boroughs. | Long form (full or vault copy). NYC: Letter of Exemplification at ordering. | State $30. NYC $15 plus a processing fee. | New York County Clerk, then the Department of State. |
| Divorce. | County Clerk of the county where it was granted. The Health Department only issues a summary certificate. | Certified copy with the County Clerk’s original signature. Exemplified copy: confirm with the office. | Clerk fees vary. Bronx and Kings once listed $25 for exemplification. | NYC counties: New York County Clerk verifies the signature. |
The County Clerk step, Manhattan and the borough records
For New York City records the County Clerk step happens in Manhattan. The New York County Clerk at 60 Centre Street verifies the signature for $3. Per the city’s 311 guidance the counter takes cash or card in person, plus money orders and business checks, but not personal checks. For a divorce granted in another county, that county’s clerk certifies first, and the Bronx and Kings clerks have listed an exemplification charge on older pages.
The City Clerk’s Marriage Bureau keeps marriage records, with its Record Room at 141 Worth Street by appointment and no walk-ins. The city’s FAQ, last updated in August 2021, lists the extended certificate for foreign use at $35 for the first copy by mail, against $15 for the ordinary one. The NYC Health Department prices death and birth copies at $15 plus a processing fee that depends on how you order, as its fee page shows. Marriage records are not held by the Health Department.
Outside the city, ask the town or county for the exact certification. Clerk fees outside New York City were not published on the pages we read.
The New York City lane, end to end

An overseas timeline for a New York file
New York keeps Eastern time, six hours behind Rome and Madrid and five behind Lisbon. City offices answer in your morning.
- 1
Work out your lane
Find who will sign the copy: the State Registrar, a local clerk, or the city. This decides whether a County Clerk step exists.
- 2
Order the right form
Ask for the long form of a death certificate and the Letter of Exemplification for New York City. Ask for the extended certificate for a city marriage. Some offices limit who may order. We help where an authorized third party is allowed, and we confirm in the review.
- 3
Deliver to a US address
Have the paper sent to our Tewksbury office or a relative. Overseas delivery wastes courier days.
- 4
County Clerk, then Department of State
We take New York City copies to 60 Centre Street, then to the Department of State counter, or send by courier where the file allows. State Health copies skip the first stop.
- 5
Check the apostille
Names, dates and the seal are checked against your passport and the foreign checklist.
- 6
Ship and track
Plan on roughly two to five business days in each direction by express courier. You get a tracking number, and the case page in ApostilleDesk stays current.
A clean New York City file can finish in days at the counters, but ordering the copies and the courier legs dominate. State mail has no published processing time, so tell us your deadline early.
Six common reasons the Department of State returns a file
A NYC copy sent straight to Albany
The Department of State will not apostille without the county step. A returned envelope costs courier days both ways.
A NYC death certificate with no exemplification
Ask for the Letter of Exemplification when you order. Adding it afterward is slower.
An abstract in place of the full copy
Online and phone orders default to a short certificate in some cases. Ask for the long form.
The ordinary certificate from the ceremony
A New York City marriage for use abroad needs the extended certificate for foreign use.
A summary certificate instead of the decree
The Health Department summary is not the County Clerk’s certified decree. Matrimonial files are confidential, so only a party or attorney can get one.
The wrong payment type
Manhattan takes no personal checks. The mail-forward service cannot be used for phone or online orders.
Italy and Spain, where New York records are asked for most
Italy
Italy is a Hague country and tightened citizenship by descent in 2025. The Chicago consulate checklist we read wants US birth, marriage and death records of the Italian line apostilled by the state that issued them, and translated into Italian. For a New York City record that means the long form, the exemplification, the County Clerk and the Department of State. Your consulate may publish a different list, and your route may no longer be open, so confirm both first.
Spain
Spain is a Hague country too. The Boston consulate’s non-lucrative visa checklist asks for family documents such as a marriage certificate to be apostilled, with civil documents issued within the last 12 months, all in Spanish. That page also says the translation does not need its own apostille. A consulate serving New York may differ, so confirm which one you must use.
Check other countries on the HCCH status table. We can provide ATA certified translations that get notarized. We are not a sworn translator and we do not arrange sworn translations, so if your destination demands one you hire that translator there, and we send the apostilled set to them.
The county and state steps, handled from Tewksbury
Boston Apostille Service is a private document preparation and courier service in Tewksbury, Massachusetts, working since 2007. We review your file for free, work out your lane, help obtain the certified copy where New York allows an authorized third party, handle the County Clerk and Department of State steps, check the result and ship it. You follow the case in ApostilleDesk. Hablamos Español.
A New York file can involve two government fees and sometimes a third, so we price it only after the review. You then see one flat-rate quote covering the state fees, our work and the return courier, and you pay after you agree. Rush is the quickest level we sell, though New York timing follows the counters. Read the pricing page and how it works, then use the application form or call (978) 424-4629 weekdays between 10am and 5pm Eastern.
We are a private company. No New York office, school or consulate is affiliated with us, and the fees above are the state’s.
Frequently asked questions
How do I get a New York record apostilled from abroad?
Order the right copy first. For New York City records, ask for the long form with a Letter of Exemplification. Then the New York County Clerk verifies it, and the Department of State apostilles it. Use a courier address in the United States for the paper. We can run the county and state steps for you after a free document review.
Does every New York record need the County Clerk first?
No. A copy issued by the State Department of Health in Albany and signed by the Director of Vital Statistics goes straight to the Department of State. Copies signed by a city, town or village clerk or a local registrar need the County Clerk of that county. New York City copies need the New York County Clerk.
What is a Letter of Exemplification?
It is the supporting letter that lets the County Clerk verify a New York City death record before the Department of State sees it. You request it from the city when you order, since the premium mail form has no extra charge for it per the city pages. Without the letter, the county step stalls and the apostille cannot follow.
Is New York apostille service really available the same day?
The Department of State has walk-in counters in New York City, Albany, Binghamton, Buffalo and Utica, and in-person service is the fast route. Hours and floors differ between the state form and the city information page, so confirm before you travel. Mail has no published processing time.
Who may order a New York divorce decree?
The County Clerk of the county where the divorce was granted issues the certified decree. Matrimonial files are confidential, so only the parties or their attorneys can usually obtain a copy. The Department of Health issues only a one page certificate of divorce summary, which is not the same thing.
How much does the New York apostille cost in state fees?
The Department of State charges $10 per document. A New York City record adds $3 for the New York County Clerk. Copies cost more, for example $15 at the city Health Department and $30 from the state. Our own fee is separate, and we send one flat-rate quote before you pay.
What if the receiving country is not in the Hague Convention?
The Department of State issues a certificate of authentication instead of an apostille, and the country embassy or consulate legalizes it afterward. Check the country on the HCCH table before you order. Our apostille versus legalization guide explains the steps, and we confirm them in the free review.
