Virginia Vital Records Apostille: The 12-Month Rule and the Triple Seal

A Virginia vital records apostille comes from the Secretary of the Commonwealth in Richmond, and only for records issued in the past 12 months. The Department of Health or a DMV office signs the copy first, with no notary. The state fee is $10 per document. Court records need a two-page Triple Seal certification from the Circuit Court clerk.

The short version

One office, one clock, one extra seal for court paper

The Virginia chain has two links. The Department of Health, or a DMV counter acting for it, issues the certified copy. The Authentication Division in Richmond then attaches the apostille. A Circuit Court clerk replaces the Department of Health for court records.

Two details decide most outcomes. The copy must have been issued within the past 12 months, and the state says Virginia law prohibits notarizing a vital record. Check the destination in the HCCH status table too. For a country outside the Convention, Virginia issues a Great Seal authentication instead, and an embassy step follows.

The death certificate that sat in a drawer for three years

A widow in Valencia kept her husband’s Virginia death certificate from 2023 in a folder. In 2026 a Spanish office asked for it with an apostille. She mailed the folder copy to Richmond and it came back. The Secretary of the Commonwealth’s page says a vital record must have been issued by VDH Vital Records or a local DMV within the past 12 months. Her copy was older, so no apostille was possible.

The fix is a fresh certified copy. That costs $15 from VDH since 1 July 2026, plus mailing. It is cheap next to the delay. So order the copy last, not first. Wait until the receiving office confirms what it wants, then order, apostille and ship in one run. Virginia is on Eastern time and Madrid is usually six hours ahead, so book calls early in your day.

In Virginia the copy has a shelf life of 12 months. Everything else follows from that.

The Triple Seal

Circuit Court records: the extra two pages

Anything a Circuit Court clerk issues, such as a divorce decree or a marriage certificate from the clerk’s office, follows a different rule from a VDH record. The Commonwealth says a court record cannot be notarized and a photocopy of a court document cannot be notarized either. It must come from the Circuit Court within the past 12 months. It should include a Certification of Official Record, known as the Triple Seal, a two-page document under Virginia Code sections 8.01-389 and 8.01-391.

The date must appear on the document, with the signature and printed name of the clerk of court. The apostille then authenticates the clerk, or a deputy clerk. Federal and out-of-state court documents are refused. When you phone the clerk, say the words “Triple Seal” and “Certification of Official Record.” Counter staff know the term.

One gap in the published rules: they list a divorce certificate under vital records and a decree under court records, but do not say which a given country will want. Ask the receiving authority. If it says “the divorce decree,” plan for the Circuit Court route.

Richmond: where to send it, what to include, what it costs

The Authentication Division charges $10 per document and $5 for each additional document with the same signer, the same date and the same destination country. Mail takes 7 to 10 business days and the drop box takes 5 to 7 business days, according to the how-to-submit page. A cover letter, created on the Commonwealth’s website, is required with every request.

Counter service is by appointment. Slots for the following week open online on Friday at 10:00 a.m. for Monday through Thursday, and each visit is limited to ten documents. From abroad, mail is the realistic route.

The office has two street addresses, and the page keeps them apart. USPS mail goes to 1111 East Broad Street, Richmond, VA 23219. FedEx, UPS, DHL, the drop box and in-person visits go to 400 East Cary Street, Richmond, VA 23219. The return envelope must list the same sender and recipient. No e-apostille is mentioned, and the page does not state counter hours here, so confirm with the office.

From abroad

A Virginia file, planned from another time zone

Nobody has to be in Richmond. But everyone has to respect the 12-month window, so the order of steps matters more here than in most states. Where Virginia allows an authorized third party, we can help obtain the copy, and we confirm that in the free review.

  1. 1

Ask the receiving office what it wants

Marriage or divorce? Certificate or decree? Long form? Ask first, because the 12-month clock starts when the copy is issued and you cannot get that time back.

  2. 2

Order the copy from VDH or a DMV office

VDH has an online ordering system. If you are abroad, route the delivery to a US address. A relative can collect from a DMV counter, but the record rules about who may order still apply, so confirm in our free review.

  3. 3

Add the Circuit Court step only for court records

Call the clerk of the county or city where the decree was entered and ask for the Triple Seal certification with the date and the clerk’s printed name.

  4. 4

Create the cover letter and mail to Richmond

Use the online cover letter, print it and enclose a return envelope with the same sender and recipient. Send it by courier to the East Cary Street address.

  5. 5

    Budget for the waits

Count 7 to 10 business days in the mail queue, plus courier days each way.

  6. 6

Ship the apostilled set with tracking

Insist on a signature at the far end.

Send the details through the application form or call (978) 424-4629, Monday to Friday, 10am to 5pm Eastern.

Rejection and delay

Six ways a Virginia file comes back

Age

A copy over 12 months old

The Commonwealth rejects vital records and Circuit Court records not issued within the past 12 months. Order fresh.

Notary

Notarizing a vital record

Virginia law prohibits it. A notarized record is rejected, and the clerk cannot fix it afterward.

Photocopy

Copy of a copy

Photocopies and altered records are on the rejection page. Only the issued certified original qualifies.

Triple Seal

A court record without it

A decree or Circuit Court marriage certificate needs the two-page certification, dated, with the clerk’s signature and printed name.

Other state

A record from elsewhere

Virginia authenticates Virginia officials only. Federal and out-of-state records are refused. Use the issuing state’s office.

Envelope

Mismatched return envelope

The return label must list the same sender and recipient. A missing or mismatched label delays the set.

These come from the Commonwealth’s document rejection page and the types-of-documents page.

Using it abroad

Spain and Germany

Spain. Spain is a Hague party. The Spanish consulate in Boston, on its non-lucrative visa page, asks for family documents such as marriage certificates to be apostilled and issued within the last 12 months. Birth certificates are excluded from that rule. Your own consulate may differ, so check it. Virginia wants a copy under 12 months old, and Spain may want the same, so order the copy late. Our Spain guide has the full sequence.

Germany. Germany is a Hague party. The German Mission’s visa FAQ says an apostille is needed on a US marriage certificate used in a residence permit application, and that German missions cannot issue apostilles. The authority in the issuing state does. For a family permit you may need the marriage certificate and the children’s birth certificates, each with its own apostille.

Translation is a separate job. We provide ATA certified translations that get notarized, but we are not a sworn translator and do not arrange sworn translations. If a Spanish or German office insists on one, hire a sworn translator there and we send the apostilled set to that person.

Virginia questions

Frequently asked questions

How do I get a Virginia record apostilled from abroad?

Order a fresh certified copy from VDH or a DMV office, with no notary, and have it sent to a US address. Add a Circuit Court Triple Seal for court records. Mail it to Richmond with the online cover letter and a $10 fee per document, then courier the finished set overseas with tracking.

How old can a Virginia certificate be for an apostille?

The Secretary of the Commonwealth requires vital records and Circuit Court records to have been issued within the past 12 months. Older copies are rejected, even if they were never opened. The destination country may have its own age rule, so also ask the receiving office before ordering.

What is the Triple Seal on a Virginia court record?

It is the Certification of Official Record, a two-page document under Virginia Code sections 8.01-389 and 8.01-391, which the Circuit Court clerk attaches. It must show the date plus the clerk’s signature and printed name. Without it, a decree or a Circuit Court marriage certificate is not accepted.

Does Virginia accept a notarized birth certificate?

No. Virginia law prohibits notarizing a vital record, and the Commonwealth rejects notarized ones. The copy must be issued by VDH Vital Records or a local DMV, and it must be the certified original rather than a photocopy. If yours was notarized, order a new certified copy.

How much does a Virginia apostille cost?

The state charges $10 per document, and $5 for each additional document with the same signer, date and destination country. A VDH certified copy costs $15 since 1 July 2026. Our service fee for a Virginia file is confirmed in the free review and quoted flat before you pay anything.

How long does the Authentication Division take?

The Commonwealth lists 7 to 10 business days for mail and 5 to 7 business days for the drop box. Add courier days in both directions. If you need the file for a consular appointment, work backward from that date and leave a buffer of several days.

Does Virginia issue an apostille or a Great Seal?

It depends on the destination. The Authentication Division issues an apostille for Hague countries and a Great Seal authentication for others. A Great Seal is usually followed by legalization at the destination country’s embassy or consulate. Check the country on the HCCH status table before you order.
