West Virginia Vital Records Apostille: Different Signer for Every Record
A West Virginia vital records apostille comes from the Secretary of State’s Business Division in Charleston. The signer on the copy changes with the record. Marriages go through the County Commission clerk, deaths through the State Registrar or that clerk, and divorces through the Circuit Clerk. The state fee is $10 and the office aims to mail results within 48 business hours.

Charleston stamps it. A county or state officer must sign first
The Business Division does not care how official a certificate looks. It cares who signed it and whether the signature is original, with the office stamp and a raised impression seal. A photocopy fails. A notary cannot stand in, because the Secretary of State says notaries cannot certify copies of records that an officer can certify.
That is why West Virginia has four short rules instead of one. Find the right officer for your record, ask for a certified copy with an original signature and seal, send it to Charleston on Form AC-1 with the destination country, and ship the finished set abroad. Check the HCCH status table for the country before you spend a dollar.

Who must sign each West Virginia record
| Record. | Who issues the copy. | Signer the Secretary of State accepts. | Copy fee. | Watch for. |
|---|---|---|---|---|
| Birth. | WV Vital Registration in Charleston or the County Commission clerk. | State Registrar or the Clerk of the County Commission where the record is on file, with the office stamp. | $12 at Vital Registration. | Original signature and a raised seal. |
| Marriage. | Clerk of the County Commission of the county where the marriage was performed. | The same clerk or a deputy, with the stamp of the office. | County fee: confirm with the clerk. $12 is the state office search fee. | The state pages name only the county clerk. Whether a state-issued marriage copy is accepted: confirm with the office. |
| Death. | WV Vital Registration (State Registrar) or the County Commission clerk where the record is on file. | State Registrar or County Commission clerk, with the stamp. | $12 per copy. Extra searches cost $12 per 3-year period. | The search fee is not refundable. Long or short form: confirm with the office. |
| Divorce. | Clerk of the Circuit Court that issued the decree. | The Circuit Clerk who issued it, with the stamp of the office. | Circuit Clerk fee: confirm with the clerk. | Not a County Commission clerk. A court order follows the same clerk rule. |
These signer rules come from the Secretary of State’s authentication page. The $12 figures come from the Vital Registration page, which sits at 350 Capitol Street, Room 165, in Charleston.
The marriage certificate ordered from the wrong counter
Picture a couple retiring to Mendoza who married in a West Virginia county in 1998. Someone tells them Charleston keeps the records, so they ask for a state copy. The Secretary of State’s list, though, names only the Clerk of the County Commission for marriage certificates. The state copy may be fine. The pages simply do not say so.
Do not guess with a document that must cross an ocean. Order the marriage certificate from the County Commission clerk of the county where the marriage happened, because that is the officer the Secretary of State names. If the state office is your only option, ask the Business Division first by phone or email whether it will authenticate a state-issued marriage copy.
Match the record to the officer the Secretary of State names. Do not match it to the office that feels central.
Charleston, Form AC-1 and a prepaid packet
The Business Division issues the apostille and uses Form AC-1. The fee is $10 for the first certification and $5 for each additional document certified by the same official. Walk-in service runs from 8:30 a.m. to 5 p.m., Monday to Friday, and the office reports that walk-ins are usually finished in minutes. By mail, it targets 48 business hours.
A mail request needs Form AC-1, the name of the destination country, a return address and a prepaid express packet if you want a courier return. The address on the page is West Virginia Secretary of State, Business Division, State Capitol Building, Charleston, WV 25305. The street and suite are not shown, so confirm them before you send a courier.
No e-apostille is offered. FBI checks are federal and go to the U.S. Department of State, not here. The pages we read do not mention counter limits per visit, so ask if you are sending a large batch.

From county clerk to Charleston to your front door
West Virginia, step by step, when you are not there
The state does not require you to appear. It requires the right original. We can help obtain the certified copy where the officer allows an authorized third party, and we confirm that during the free review.
- 1
Identify the right officer
Use the signer map above. Marriage means the County Commission clerk of the county. Divorce means the Circuit Clerk. Birth and death can come from the State Registrar or the county.
- 2
Request the certified copy with original signature and seal
Say exactly that on the request. Ask for the stamp of the office. Have it mailed to a US address, not abroad, because Charleston needs the original.
- 3
Check the identity rules for restricted records
The pages we read do not list who may order each record, so ask the clerk. If you cannot order yourself, tell us in the free review whether an authorized third party can.
- 4
Fill in Form AC-1
Name the destination country, add a return address and decide whether you want a prepaid express packet. Include $10 for the first document and $5 for each more by the same official.
- 5
Send to Charleston or have someone walk it in
Mail is targeted at 48 business hours. A walk-in is usually served in minutes. From abroad, mail or a courier is the realistic route.
- 6
Ship abroad with tracking
Argentina is one to two hours ahead of West Virginia, Italy is six. Book calls with the receiving office to suit their day. Courier times vary by country and customs.
Send the record type and county through the application form or call (978) 424-4629, Monday to Friday, 10am to 5pm Eastern.
Six reasons Charleston sends a file back
State copy of a county record
A marriage copy from the wrong counter may not match the clerk the Secretary of State names. Order from the County Commission clerk.
A flat or photocopied certificate
The copy needs the officer’s original signature and a raised impression seal. A scan or print is not enough.
A notary certifying the copy
Notaries cannot certify copies of records that a clerk or registrar can certify. Ask the officer, not a notary.
Signature without the office stamp
The Secretary of State’s list adds the words “bearing the stamp of the office.” Check the copy before you mail it.
A decree from the wrong court
A divorce decree must be certified by the Circuit Clerk who issued the decree. A County Commission clerk is the wrong signer.
Missing Form AC-1 or country
The request needs the form, the destination country and a return address. A missing item stalls the file.
Italy and Argentina
Italy. Italy is a Hague party, so the West Virginia apostille is the right step. The Italian consulate in Chicago’s checklist, version dated 18 August 2026, asks for US birth, marriage and death records of the Italian line with an apostille from the issuing state. It also wants an Italian translation and long-form certified copies. Citizenship by descent rules changed in 2025, so ask the consulate whether your line qualifies. Our Italy guide explains the paper chain.
Argentina. Argentina is a Hague party. The national migration directorate’s pages for temporary residence as a rentista, pensionado or student say foreign documents need an apostille from a Hague country, must be originals, and need a Spanish translation by a traductor público nacional, legalized by the translators’ college. Those pages also say the applicant must be in Argentine territory.
We provide ATA certified translations that get notarized, but we are not a sworn translator and we do not arrange sworn translations. For Argentina you hire a traductor público there, and we ship the apostilled originals to that person.

Frequently asked questions
How do I get a West Virginia record apostilled from abroad?
Get a certified copy from the officer the Secretary of State names for that record, with an original signature, office stamp and raised seal. Mail it to the Business Division in Charleston with Form AC-1, the destination country and a return address. A courier or a US contact handles the shipping, since the original must stay in the US for the apostille.
Who signs a West Virginia marriage certificate for an apostille?
The Clerk of the County Commission of the county where the marriage was performed, bearing the stamp of the office. That is the only officer the Secretary of State names for marriages. Whether a copy issued by the state Vital Registration office is accepted is not stated, so confirm with the Business Division.
Does a West Virginia divorce decree need a notary?
No. A divorce decree is certified by the Clerk of the Circuit Court that issued it, with the stamp of the office. A notary cannot certify a record that an officer can certify. Confirm the Circuit Clerk fee with the court, because it is not on the Secretary of State pages we read.
How much is the West Virginia apostille fee?
The Secretary of State charges $10 for the first document and $5 for each additional document certified by the same official. The state Vital Registration office charges $12 per copy, and that includes the search. County and Circuit Clerk fees are not published on those pages, so ask the clerk.
How fast does the West Virginia Secretary of State respond?
The office reports that walk-ins are usually served in minutes and targets 48 business hours for mail. Those are targets, not promises, and they do not include the days your certified copy spends in transit. Add courier time in both directions when you plan around an appointment abroad.
What is a raised impression seal?
It is an embossed seal pressed into the paper by the clerk or registrar, not a printed logo. The Secretary of State requires one together with the original signature and the stamp of the office. Photocopies, scans and flat printouts do not show it, so they are not accepted.
Which West Virginia office can I order a death certificate from?
You can order from the State Registrar at Vital Registration in Charleston or from the Clerk of the County Commission where the record is on file. Both signers are accepted for the apostille. The Vital Registration fee is $12 per copy, and the search fee is not refundable.
