Can an Online Notarization Be Apostilled in Massachusetts? What Is Accepted in 2026
You found a website that notarizes documents over video in ten minutes. The question is whether the Commonwealth will apostille the result and whether the foreign office will accept it. Massachusetts passed a remote online notarization law in 2023 and has not switched it on. Here is where that leaves you, what other states‘ online notarizations mean for a Massachusetts apostille and which countries refuse remote notarizations no matter which state issued them.
- In person and mobile notarization statewide
- Wet ink signatures foreign offices accept

A law on the books, a program not yet running
Massachusetts authorized remote online notarization in 2023. The statute lets a commissioned notary perform a notarial act for a signer who appears by audio-video connection, after the notary completes state training, registers with the Secretary of the Commonwealth and uses an approved platform. The Secretary’s office has said plainly on its own commissions page that the training and the notification form are not yet available and that notaries should not use remote platforms until they are. The office sought information from technology vendors in 2024 and is still writing regulations.
The practical result in September 2026: a Massachusetts notary who notarizes you over video is acting outside the program, and the Commissions Section will not apostille a certificate that says the signer appeared remotely. A Massachusetts notary can still notarize in person anywhere in the Commonwealth, and that is the notarization the state apostilles every day.
Massachusetts did allow a temporary form of video notarization during the pandemic emergency. That authority ended in 2023 and was replaced by the permanent statute that is still waiting on regulations. Documents notarized under the emergency rules were valid at the time. New ones cannot be created under it.
The Commonwealth apostilles the notary on file. A remote notarization has no place in that file until the program opens.
Remote notarization, electronic notarization and e-apostilles are not the same
The word “online” hides three different processes, and the answer to “will it be apostilled” is different for each.
Remote online notarization
The signer and the notary are in different places, connected by video. Identity is checked by credential analysis and knowledge questions. The document is signed and sealed electronically. Legal in most states, not yet operational in Massachusetts, and rejected by many foreign offices for private documents.
Electronic notarization
The signer is physically in front of the notary, but the document and the seal are digital. This is an in person act with an electronic output. Massachusetts has no active electronic notarization program either, so the output the Commonwealth apostilles is paper.
Electronic apostille
The apostille itself is issued as a digitally signed file and verified through an online register. Several states and the U.S. Department of State are moving this way. Massachusetts issues paper apostilles. Our digital document guide covers what happens to a PDF that needs an apostille.
A remote notarization from Florida, Texas or Virginia is real. It is also not a Massachusetts document.
Most of the national online notary platforms use notaries commissioned in states with mature remote programs. When you use one, your document is notarized under that state’s law by that state’s notary, and only that state’s Secretary of State can apostille it. Sending it to One Ashburton Place returns it unprocessed, because the Commonwealth has no file for a Florida notary.
That route works when two things are true. The other state must apostille remotely notarized documents, and most that permit RON do, sometimes with a printed paper copy certified by the notary. And the destination country must accept a remotely notarized private document, which is the larger question.
Where it fails
Spain’s consulates and registries want wet ink notarization for powers of attorney and affidavits. Italian comuni and notai expect the same for procure. Portugal, Brazil, Mexico, Colombia and most of Latin America follow the civil law view that a notary must be physically present. Some countries have started accepting electronic apostilles on public records while still refusing remote notarizations on private ones, which confuses people who assume the two go together. Our guide to translation and apostille sequencing explains how these countries read a file.
Where it works
The United Kingdom, Ireland, Canada, Australia and many corporate registries accept remotely notarized documents with an apostille from the notary’s state, especially for company resolutions, certified copies and declarations. Even there, the receiving party decides, and a bank compliance desk can refuse what a registry accepts.
What the Massachusetts program will require when it opens
The 2023 statute sets the shape of the program even though the office has not switched it on. A notary who wants to notarize remotely will have to complete a state approved course, notify the Secretary of the Commonwealth before performing the first remote act, use a platform the Secretary has approved, verify the signer’s identity through credential analysis and identity proofing rather than personal knowledge alone, keep an audio-video recording of every session for a set number of years, and record each act in an electronic journal. The signer will have to be located in Massachusetts, or outside it under conditions the regulations will spell out, and the notarial certificate will have to state that the act was performed by remote communication. The document produced will be electronic, with a paper copy certified by the notary available for offices that want paper.
Two consequences follow for apostilles. First, the Commissions Section will need a way to verify the electronic seal and the remote certificate against its file, which is part of what the regulations must build before the program opens. Second, even after it opens, the certificate’s own words will tell every foreign office that the signer was not physically present, and the countries listed above will refuse it for the same documents they refuse today. The program will make remote notarization legal in Massachusetts. It will not make Spain accept it.
What to do while you wait
Sign in person. Our office in Tewksbury handles walk-ins during business hours, and a mobile notary covers eastern Massachusetts for anyone who cannot travel. When the program opens we will update this guide with the date, the platform list and which foreign offices have said they accept the result.
The question to ask before you pay for a video session
Ask the receiving office: “Do you accept a document notarized by remote online notarization with an apostille from the notary’s state?” If the answer is anything other than yes in writing, sign in person.
Remote or in person?
- Destination is Spain, Italy, Portugal, Brazil, Mexico or Latin America: in person.
- Document is a power of attorney, affidavit or consent: in person.
- Document is a company resolution for the UK, Ireland, Canada or Australia and the recipient has said yes in writing: remote through the notary’s state is an option.
- You need a Massachusetts apostille specifically: in person with a Massachusetts notary.
How to get a wet ink Massachusetts notarization from far away
Sign at a U.S. embassy or consulate
Consular officers notarize documents for U.S. citizens abroad. A consular notarization is a federal act, authenticated by the U.S. Department of State rather than by Massachusetts, and accepted in every Hague country. Appointments take time to book, so start early. Our guide for clients abroad covers the steps.
Check the platform’s state before you start
Every national video notary platform assigns you a notary from a state whose law it operates under, and that state is printed on the certificate. Ask which state before the session, then confirm that state apostilles remote notarizations and that the receiving office abroad accepts them. If the answer to either is no, the ten minute session buys nothing.
Sign in front of a local notary in the country you are in
A document notarized by a Spanish notario or a French notaire is a Spanish or French document and gets its apostille there. For a document that is going to be used in that same country, this is often the simplest answer.
Give someone in Massachusetts a power of attorney
A trusted person here signs and requests documents on your behalf. The power of attorney itself must be executed properly, which for most countries means in person, so this is a step to take before you leave. The power of attorney guide explains what it needs to say.
Use a remote notary from another state, when the destination allows it
For corporate documents to English speaking countries, a remote notarization through a state with an active program, apostilled by that state, is a workable route. We coordinate it when the receiving office has confirmed acceptance in writing.
Three online notarizations and what happened to them
Names changed. Each one arrived after the client had already paid for a video session.
Rejected by the Spanish notario
A client in Cambridge signed a power of attorney over video with a Virginia notary, obtained a Virginia apostille and sent it to Spain. The notario handling the sale refused it: Spanish practice requires the grantor to appear physically before a notary. She signed again in our office before a Massachusetts notary, we walked it into One Ashburton Place and the sworn translation followed. The sale closed two weeks late.
Accepted, with one condition
A Boston startup’s director signed a board resolution by remote notarization with a Texas notary. The Irish bank accepted a remotely notarized resolution with an apostille, but wanted the notary’s certificate to state that the act was performed by audio-video communication. The Texas certificate did. Texas apostilled the printed copy and the account opened.
Returned by the Commonwealth
A client in Worcester found a Massachusetts notary willing to notarize an affidavit over video in 2025. The certificate described a remote appearance. The Commissions Section returned it, since the remote program is not in operation. The affidavit was re-sworn in person the following day and apostilled the same week.
What the three share
The technology worked in every case. What decided the outcome was the law of the notary’s state and the rules of the receiving office. Those are the two questions to answer before the video session, and the second is the one people skip.
What we recommend in 2026
For anything going to a civil law country, or anything that is a power of attorney or sworn statement, sign in person. Our office in Tewksbury notarizes during business hours without an appointment, and a mobile notary meets you at home, at a hospital or at your attorney’s office across eastern Massachusetts. The apostille vs notary guide explains the two roles for anyone still sorting out which one they need.
What notarization plus apostille costs
The Commonwealth charges $6 per apostille. Our Massachusetts service starts at $149.95 per document and includes in person notarization at our office, the review of the certificate against the destination’s rules, the trip to One Ashburton Place, courier and tracking. Can I get a document notarized online and apostilled in Massachusetts?
Not in 2026. Massachusetts authorized remote online notarization by statute in 2023 but the Secretary of the Commonwealth has not opened the program, and the Commissions Section does not apostille certificates that describe a remote appearance. In person notarization by a Massachusetts notary is apostilled every day.
Is remote online notarization legal in Massachusetts?
The law exists, but the state has told notaries not to use remote platforms until training, registration and regulations are in place. Until then a remote notarization by a Massachusetts notary is outside the program.
Can Massachusetts apostille a document notarized online by a Florida or Texas notary?
No. Only the state that commissioned the notary can apostille that notary’s act. A Florida remote notarization is apostilled in Tallahassee.
Which countries refuse remotely notarized documents?
Spain, Italy, Portugal, Brazil, Mexico and most civil law countries for powers of attorney, affidavits and consents. Some accept them for corporate certified copies. Ask the receiving office in writing before using a video notary.
What is the difference between electronic notarization and remote notarization?
Electronic notarization is an in person act with a digital signature and seal. Remote notarization is an act performed over video. Massachusetts has neither program running, so its notarizations are in person and on paper.
Does Massachusetts issue electronic apostilles?
No. The Commonwealth issues paper apostilles attached to the document. Several other states and the U.S. Department of State are introducing electronic apostilles for some document types.
I am abroad and need a Massachusetts notarization. What are my options?
Sign at a U.S. embassy or consulate, which is then authenticated federally. Or have a person holding your power of attorney sign in Massachusetts. Or, for corporate documents to countries that accept it, use a remote notary from a state with an active program and that state’s apostille.
When will Massachusetts remote notarization start?
The Secretary of the Commonwealth has not announced a date. The office collected information from platform vendors in 2024 and is drafting regulations. We will update this guide when the training and notification form go live.
